Terms of Service

1. Acceptance of Terms

By accessing or using Verse AI at verse.horven.org (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not access or use the Service.

2. Description of Service

Verse AI is a subscription-based AI assistant specialized in the Verse programming language and Unreal Editor for Fortnite (UEFN). The Service provides AI-generated code suggestions, explanations, and development assistance.

Verse AI is an independent product and is not affiliated with, endorsed by, or sponsored by Epic Games, Inc. "Fortnite", "Unreal Engine", "UEFN", and "Verse" are trademarks of Epic Games, Inc.

3. Eligibility

  • You must be at least 16 years old to use the Service. If you are between 16 and 18, you must have parental or guardian consent.
  • By using the Service, you represent that you meet these requirements.

4. Account Registration

  • You must provide a valid email address and create a secure password.
  • You are solely responsible for all activity under your account.
  • You must not share, sell, or transfer your account to another person.
  • You must notify us immediately at horven.socials@gmail.com if you suspect unauthorized access to your account.

5. Subscription, Payment, and Refunds

  • Access to the AI assistant requires an active paid subscription.
  • All payments are processed securely through Stripe, Inc. We do not store your payment card information.
  • Subscriptions are billed monthly and renew automatically until canceled.
  • You authorize us to charge your payment method on a recurring basis.
  • You may cancel your subscription at any time through the Stripe customer portal accessible from the Settings page. Cancellation takes effect at the end of the current billing cycle — you retain access until then.
  • Refund policy: Because the Service provides immediate access to AI-generated content upon subscription, refunds are generally not available. We may, at our sole discretion, issue refunds in exceptional circumstances (e.g., accidental duplicate charges). Refund requests must be submitted within 7 days of the charge to horven.socials@gmail.com.
  • We reserve the right to change subscription pricing with 30 days' notice. Price changes do not affect your current billing period.

6. Usage Limits

The Service includes a monthly usage budget included with your subscription. Usage is distributed dynamically across the billing period to ensure availability throughout the month. When your daily or monthly limit is reached, access to the AI chat is temporarily restricted until the limit resets. Usage limits are not grounds for a refund.

7. Acceptable Use

You agree not to:

  • Use the Service for any illegal, harmful, or unauthorized purpose.
  • Attempt to bypass, circumvent, or tamper with usage limits, authentication, subscription verification, or any other security measure.
  • Use automated scripts, bots, scrapers, or other automated means to access the Service.
  • Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the Service.
  • Resell, sublicense, redistribute, or commercially exploit access to the Service without written permission.
  • Send content that is harmful, abusive, threatening, defamatory, obscene, or otherwise objectionable.
  • Use the Service to generate malware, exploits, or content that facilitates harm to others.
  • Use the Service to generate content that infringes on intellectual property rights of third parties.
  • Intentionally overload the Service or interfere with its operation.

8. AI-Generated Content

  • The Service provides AI-generated responses for informational and development assistance purposes only.
  • No warranty on output: AI-generated responses may contain errors, inaccuracies, bugs, security vulnerabilities, or outdated information. You are solely responsible for reviewing, testing, and validating any code or advice before using it in any project, product, or production environment.
  • We do not guarantee that AI-generated code will compile, function correctly, be free of security vulnerabilities, or be fit for any particular purpose.
  • Not professional advice: AI output does not constitute professional, legal, or expert advice.
  • You retain ownership of your input (prompts). AI-generated responses are provided under a non-exclusive, worldwide license for your personal and commercial use.
  • We do not claim ownership of AI-generated output, but we also do not guarantee that output is unique or free from similarities to other works.

9. Intellectual Property

  • The Service, including its design, features, and code (excluding AI-generated output), is owned by Verse AI and protected by applicable intellectual property laws.
  • You may not copy, modify, or create derivative works from the Service itself.
  • The Verse AI name and logo are our trademarks. You may not use them without written permission.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY CONTENT OR OUTPUT WILL BE ACCURATE OR RELIABLE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, revenue, business opportunities, or goodwill.
  • We shall not be liable for any damages resulting from AI-generated code or advice, including but not limited to software bugs, data loss, security vulnerabilities, downtime, or any harm to your projects or end users.
  • We shall not be liable for any damages caused by third-party services (Stripe, hosting providers, AI model provider).
  • Our total aggregate liability for all claims arising from or related to the Service shall not exceed the total amount you paid for the Service in the 3 months immediately preceding the event giving rise to the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Verse AI, its owners, operators, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; (d) any content you submit through the Service; or (e) your use of AI-generated output.

13. Service Availability and Modifications

  • We strive to maintain high availability but do not guarantee uninterrupted or error-free access.
  • The Service may be temporarily unavailable due to maintenance, updates, technical issues, or circumstances beyond our control.
  • We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.
  • Scheduled downtime does not entitle you to a refund or credit.

14. Termination

  • You may terminate your account at any time by canceling your subscription and contacting us to delete your account.
  • We may suspend or terminate your account immediately, without prior notice, if you violate these Terms or engage in activity that may harm the Service or other users.
  • Upon termination, your right to access the Service ceases immediately.
  • We may retain your data for up to 30 days after termination for legal and operational purposes, after which it will be deleted.
  • Sections 8, 10, 11, 12, and 16 survive termination.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated by updating the "Last updated" date and, where feasible, notifying users via email. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. If you disagree with the updated Terms, you must stop using the Service and cancel your subscription.

16. Governing Law and Disputes

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Verse AI regarding the use of the Service and supersede all prior agreements.
